Suit: Servicemembers fleeced by student loans

WASHINGTON — Federal authorities announced a proposed $60 million settlement Tuesday in a lawsuit alleging that thousands of military servicemembers were charged excessive interest rates for student loans.

The legal action, the first of its kind filed against student loan owners and processors for alleged violations of the Servicemembers Civil Relief Act, involves about 60,000 servicemembers who were charged rates in excess of the maximum 6%.

Attorney General Eric Holder and Education Secretary Arne Duncan said the settlement involving Sallie Mae, now known as Navient, awaits approval by a federal judge in Delaware.

Holder said the lenders engaged in "a nationwide practice'' for nearly a decade that failed to provide military members the 6% rate.

"This alleged overcharging appears to have been the rule, rather than the exception,'' Holder said. "According to an audit, excessive rates were charged to 93% of active-duty servicemembers who had loans owned or serviced by Sallie Mae.''

If approved, proceeds of the settlement would be distributed among the 60,000 members.

The government alleged that the lenders improperly obtained default judgments against servicemembers who were protected under the Civil Relief Act.

As a result, the terms of the proposed deal require lenders to request that credit agencies delete any negative entries based on the interest overcharges and default judgments.

"This type of conduct is more than just inappropriate,'' Holder said. "It is inexcusable. And it will not be tolerated.''

Holder said lenders cooperated with the inquiry and endorsed the settlement proposal.

"We offer our sincere apologies to the servicemen and servicewomen who were affected by our processing errors and thus did not receive the full benefits they deserve,'' Navient President John Remondi said. "Over the past several years, we have implemented changes in our procedures and training programs to prevent these mistakes from happening again.''

"We regret any inconvenience or hardship that our customers may have experienced,'' Sallie Mae Bank said in a statement. "Initiatives are underway to prevent such errors from recurring and apply the clear regulatory guidance these orders now provide.''

    WY and the majority of the timber, forest and paper products companies have a track record of unimpressive returns on capital, cyclical revenue and profit trends, heavy use of capital expenditures, and significant environmental regulation. We also think that WY's conversion to a REIT was a mistake. Morningstar Investment Research's Timber, Forest and Paper Products analyst Dan Rohr said it best when he rated WY and its Timber REIT peers Rayonier (RYN), Potlatch (PCH) and Plum Creek (PCL) as not possessing any economic moat. That probably explains why we only have an ancillary exposure to this industry for our proprietary portfolio based on our holdings in Brookfield Infrastructure (BIP) and Cintas (CTAS). It's a New Era for Amusement Parks (IFLM, DIS, SIX)

Are you and/or your kids a little bit bored with the theme parks being run by The Walt Disney Company (NYSE:DIS) or Six Flags Entertainment Corp. (NYSE:SIX)? As it turns out, you're not alone. While Six Flags Entertainment may be the king of the roller coaster wars (in quantity, with some good quality in the mix too) and Disney Land and Disney World are of course two of the most-polished and charming amusement parks in the world, in a world that's increasingly digital and a culture that's increasingly loves being spooked and mystified, DIS and SIX may be missing the proverbial boat. It's an up-and-coming theme park like the one(s) being designed by Independent Film Development Corporation (OTCMKTS:IFLM) - aka IndyFilmCorp - that's poised to hit the new consumer nail on the head.

Just as the name would imply, by Independent Film Development Corporation is the owner of a decent library of rights to television shows and movies (The Three Stooges, for one), and the maker of some other solid television programs (for example, the Autograph celebrity spotlight series). But a foray into amusement parks? It's not as crazy as it sounds. Indeed, aside from the fact that it worked for The Walt Disney Company, it's perfectly fitting that an organization involved in film and television is developing the next great theme park.

The digital-loving, wanna-be-scared society mentioned above? One only has to look at what's now popular on theater scenes and television to see tastes have changed. Movie franchises like the Twilight saga and Underworld series - both about vampires and werewolves - wouldn't likely have been smashing success 20 years ago, and that's IF they could have gotten made. And now, TV-watchers are quite likely to flip over to an episode of Ghost Hunters, Ancient Aliens, or Most Evil... a show about using forensics to solve some of the most horrific crimes ever committed.

Likewise, one only has to look at some of the world's most popular theme park rides to realize there's a paradigm shift in the kinds of entertainment people want to experience. At Universal Studios in Orlando, the park is home to one "full-sized" thrill coaster. The next-biggest coaster is The Mummy, which as a coaster itself less than thrilling, but as a ride, is one of the best in the park because it immerses riders into a The Mummy movie experience as a character. The next-three most popular attractions are Shrek 4D, Minion Mayhem (a la Despicable Me), and the Transformers Ride... all of them 3D "immersive experience rides", where the screen moves more than the rider. Indeed, in Minion Mayhem and Shrek4D, guests don't move at all. They just watch.

Great, but what does any of that have to do with how Independent Film Development Corporation compares to theme parks owned by The Walt Disney Company or Six Flags Entertainment Corp.? Not that roller coasters and water flumes are going to completely disappear, but there's a clear preference for (1) things that are fascinating because they seem real and a little dangerous (like a 25-foot tall robot with a bad attitude), and (2) attractions that immerse you in an experience rather than just let you watch it (like a mummy chasing you out of a flame-engulfed pyramid tomb). Who better to serve up those thrills and chills that you see and live on the big screen and the small screen than a company that makes television shows and movies?

And that's exactly what IndyFilmCorp is doing. At a 500-acre piece of land in the Catskills, IFLM is planning a theme park to be built around an existing 320 room resort hotel... a theme park that will make real the things that have only lived in our imaginations, or lived on TV or movie screens, by tapping into years of television and movie-making experience.  At this park - perhaps the first of many like it - you're more likely to find Bigfoot lurking around in the trees than you are to find a lovable cartoon character walking around passing out hugs. It will be home to a water-based log ride with the requisite big splash at the end, but this ride will be an escape from Hades via a bumpy ride down the River Styx? And, the haunted house will actually look like it's haunted, rather than just infested with giggling ghosts.

It sounds intense. That's because it is. That's because that's what consumers want.

There's still lots of work to be done, and plenty of planning. But, the ball is rolling. Independent Film Development Corporation owns the land and the existing hotel, and the company is already working with some of Hollywood's top set designers and special effects people.

Is it the next The Walt Disney Company or the next Six Flags Entertainment Corp.? Only time will really tell, but as far as investments go, SIX and DIS have rewarded shareholders pretty well. IFLM may well end up doing the same.

American Funds makes push to increase transparency

In a bid to win back investors, American Funds is increasing the transparency around how its mutual funds are managed but it won't be going as far as revealing individual manager performance and holdings.

Each American Fund is run by a team of portfolio managers, but each manager runs his or her own sleeve independently. For example, the $123 billion American Funds Growth Fund of America (AGTHX) has 12 managers who are each responsible for their own portion of the fund. Details about the individual managers, however, has been scarce, the company is in the process of changing that.

For the first time, the Los Angeles-based company is preparing reports that will detail the decision making process behind building the team that manages each mutual fund, including notes on each managers' investment style, strengths, and weaknesses, spokesman Chuck Freadhoff said.

“It's something that hasn't been fully understood before,” he said. “We haven't explained it well.”

The reports won't go as far as revealing each manager's performance or portfolio holdings, though, because Mr. Freadhoff said that information isn't actionable.

“It may be interesting, but you can't invest in a single manager,” he said. “You're investing in the entire fund.”

Some financial advisers see the move as encouraging.

“If they're willing to share more information and more insight into their funds I don't see a downside to that,” said Melissa Hammel, managing member of Hammel Finanical Advisory Group LLC. Ms. Hammel has clients invested in several American Funds, including the $32 billion American Funds AMCAP Fund (AMCPX).

Jim Johnson, partner at Lighthouse Financial Planning LLC, has had as much as half his clients' assets in American Funds, but only has them in the firm's bond funds today.

“Anybody who has been through one of their meetings knows it's pretty clear how they do what they do,” he said. “If they have a way to communicate that without people having to go to their headquarters, I think it's a great idea.”

The detailed fund manager reports are just one step American Funds, which has suffered withdrawals of $242 billion since 2007, is taking to increase transparency. The firm’s assets total $993 billion, down from $1.15 trillion in 2007.

The company has already begun making portfolio holdings available 15 days after months' end and offering quarterly attribution analysis, reports that show advisers which holdings have been added, or subtracted, from an individual fund's performance that quarter.

In addition, advisers can expect to start seeing more American Funds portfolio managers at industry conferences, in the media, and appearing on financial TV networks.

“We know we need to communicate as broadly as we can,” Mr. Freadhoff said.

American Funds kicke! d off its increased outreach to advisers last year with the launch of its “The Long View” reports, which shared the company's insights into trends affecting the economy.

At the heart of the transparency efforts are registered investment advisers. American Funds are predominately sold through brokers, 64% of its fund assets are in load-rich A-shares, but the company is making a big push to court RIAs, who are mainly fee-based.

“RIAs like to interact differently than the traditional transaction-based broker,” Mr. Freadhoff said. “They ask for more detailed information. They need to know what you think and what your views are.”

The effort is paying off so far, in terms of recognition, if not money flows.

“Several years ago, anyone outside of the small RIA team [at American Funds] didn't seem to know what an RIA was,” Mr. Johnson said. “That's certainly not the case today. I'm absolutely seeing progress.”

American Funds has approximately $92 billion, or 9% of total fund assets, in its F-share classes, which don't have load fees, up from $72 billion, or 7% of total fund assets, in 2008.

Still, investors have pulled $11.5 billion from the funds this year even as the equity markets have rallied and performance across the American Funds lineup has improved.

The American Growth Fund of America, for example, outperformed the S&P 500 by 400 basis points in 2012 and its 23.87% return year-to-date through Sept. 18 tops the S&P 500 as well. Its 10-year annualized returns are almost 400 basis points better than the S&P 500 and rank it among the top 10% of large-cap mutual funds, according to Morningstar.

But the fund's underperformance in 2008, when it fell 39% versus the S&P 500's 37% drop, and in 2011, still drag down its three- and five-year annualized returns.

Banco Bradesco S.A. (the Bank), incorporated on November 5, 1943, is commercial bank. The Bank offers a range of banking and financial products and services in Brazil and abroad to individuals, large, midsized and small companies and local and international corporations and institutions. It operates in two segments: the banking, and the insurance, pension and capitalization bonds. Banking

The Bank offers a variety of deposit products and services to our customers through its branches, including Non-interest bearing checking accounts, such as Easy Account, Click Account, Academic Account and Cell Phone Bonus Account; traditional savings accounts; time deposits, and deposits from financial institutions. As of December 31, 2011, it had 43.4 million savings a! ccounts. It offers its customers certain additional services, such as identified deposits and real-time banking transfers. Its loans and advances to customers, consumer credit, corporate and agricultural-sector loans, totaled R$263.5 billion as of December 31, 2011.

The Bank�� loan portfolio consists of short-term loans, vehicle financings and overdraft loans on checking accounts. It also provides revolving credit facilities and traditional term loans. As of December 31, 2011, it had outstanding advances, vehicle financings, consumer loans and revolving credit totaling R$58.0 billion, or 22.0% of its portfolio of loans and advances. Banco Bradesco Financiamentos (Bradesco Financiamentos) offers direct-to-consumer credit and leasing for the acquisition of vehicles and payroll-deductible loans to the public and private sectors 'in Brazil. Supported by BF Promotora de Vendas Ltda. (BF Promotora), and using the Bradesco Financiamentos brand, the Bank operates through its network of correspondents in Brazil, consisting of retailers and dealers selling light vehicles, trucks and motorcycles, to offer financing and/or leasing for vehicles. Through Bradesco Promotora brand, it offer payroll-deductible loans to social security retirees and pensioners, public-sector employees, military personnel and private-sector companies sponsoring plans, and other aggregated products (insurance, capitalization bonds, cards, purchasing consortiums, and others).

As of December 31, 2011, the Bank had 63,156 outstanding real estate loans. As of December 31, 2011, the aggregate outstanding amount of its real estate loans amounted to R$15.9 billion, representing 6% of its portfolio of loans and advances. As of December 31, 2011, it had 69,491 microcredit loans outstanding, totaling R$62.8 million. Its BNDES onlending portfolio totaled R$35.4 billion as of December 31, 2011.

The Bank provides traditional loans for the ongoing needs of its corporate customers. It had R$85.8 billion of outstand! ing other! local commercial loans, accounting for 32.5% of its portfolio of loans and advances as of December 31, 2011. It offers a range of loans to its Brazilian corporate customers, including short-term loans of 29 days or less; guaranteed checking accounts and corporate overdraft loans; discounting trade receivables, promissory notes, checks, credit card and supplier receivables, and a number of other receivables; financing for purchase and sale of goods and services; corporate real estate financing, and investment lines for acquisition of assets and machinery. As of December 31, 2011, the Bank had R$11 billion in outstanding rural loans, representing 4.2% of its portfolio of loans and advances. The Bank conducts its leasing operations through its primary leasing subsidiary, Bradesco Leasing and also through Bradesco Financiamentos.

The Bank offers electronic solutions for receipt and payment management solutions, which include collection and payment services and online resource management enabling its customers to pay suppliers, salaries, and taxes and other levies to governmental or public entities. The global cash management concept provides solutions for multinationals in Brazil and/or domestic companies operating abroad. It manages third-party assets through mutual funds; individual and corporate investment portfolios; pension funds, including assets guaranteeing the technical provisions of Bradesco Vida e Previdencia, and insurance companies, including assets guaranteeing the technical provisions of Bradesco Seguros.
